IMPORTANT LEGAL NOTICE - PLEASE READ CAREFULLY
THIS AGREEMENT CONTAINS IMPORTANT PROVISIONS INCLUDING AN ASSUMPTION OF RISK, RELEASE OF LIABILITY, INDEMNIFICATION, AND BINDING ARBITRATION CLAUSE. BY USING THIS PLATFORM, YOU ARE AGREEING TO THESE TERMS AND WAIVING CERTAIN LEGAL RIGHTS. IF YOU DO NOT AGREE, DO NOT USE THIS PLATFORM.

1. Acceptance of Terms
By accessing, browsing, or using the Hunt My Land platform ("Platform"), website, mobile applications, or any services provided by Hunt My Land USA, LLC ("Company," "we," "us," or "our"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and User Agreement ("Agreement" or "Terms").
This Agreement constitutes a legally binding contract between you and Hunt My Land USA, LLC. Your use of the Platform signifies your acceptance of these Terms and your agreement to comply with all applicable federal, state, and local laws and regulations.
IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THIS PLATFORM AND MUST IMMEDIATELY CEASE ALL USE.
We reserve the right to modify these Terms at any time. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
2. Definitions
For purposes of this Agreement, the following definitions apply:
- "Platform" means the Hunt My Land website, mobile applications, and all related services.
- "User" means any individual or entity that accesses or uses the Platform, including Hunters and Landowners.
- "Hunter" means any User who books or uses property through the Platform for hunting, fishing, or outdoor recreational activities.
- "Landowner" means any User who lists property on the Platform for rental to Hunters.
- "Property" means any land, premises, or location listed on the Platform.
- "Booking" means a reservation made through the Platform for access to a Property.
- "Activities" means hunting, fishing, and any other outdoor recreational activities conducted on a Property.
- "Guest" means any individual accompanying a Hunter to a Property.
- "Content" means all text, images, data, and other materials submitted to or displayed on the Platform.
- "Services" means all services provided through the Platform, including booking, payment processing, and communication tools.
3. Platform Description & Scope of Services
3.1 Platform Purpose
Hunt My Land operates as an online marketplace platform that connects Landowners who wish to rent their property for hunting, fishing, and outdoor recreational activities with Hunters seeking access to such properties. The Platform facilitates discovery, communication, booking, and payment processing between Users.
3.2 Scope of Services
Our Services are limited to providing a technology platform that enables connections between Landowners and Hunters. We provide:
- Property listing and search functionality
- Secure booking and reservation systems
- Payment processing through third-party providers
- Communication tools between Users
- Review and rating systems
- Document management capabilities
3.3 Platform Limitations
Hunt My Land does NOT:
- Own, operate, manage, or control any Properties listed on the Platform
- Inspect, verify, or certify the condition, safety, or legality of any Property
- Employ, supervise, or control any Landowner or Hunter
- Guarantee the accuracy of any listing, description, or User-provided information
- Provide hunting guides, outfitting services, or equipment
- Verify hunting skills, experience, or qualifications of Users
- Guarantee wildlife availability or hunting success
- Provide insurance coverage for Users or Properties
- Mediate or resolve disputes between Users except as expressly stated
4. User Eligibility Requirements
4.1 Age Requirement
You must be at least eighteen (18) years of age to use this Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this binding Agreement. Minors may only participate in Activities when accompanied and supervised by a registered adult User who accepts full responsibility for the minor's actions and safety.
4.2 Legal Capacity
You represent that you have the legal authority and capacity to enter into contracts and agreements. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
4.3 Geographic Eligibility
The Platform is intended for use within the United States of America. Users are responsible for compliance with all applicable laws in their jurisdiction. Properties may only be listed in states where such activities are legally permitted.
4.4 Prohibited Users
You may not use the Platform if you:
- Have been convicted of any felony or violent crime
- Are a registered sex offender
- Have had hunting or fishing licenses revoked or suspended
- Are prohibited by law from possessing firearms or engaging in hunting activities
- Have been previously banned or removed from the Platform
- Are located in a jurisdiction where use of the Platform is prohibited
5. Account Registration & Security
5.1 Account Creation
To access certain features of the Platform, you must register for an account. During registration, you agree to provide accurate, current, and complete information. You must update your information promptly if it changes.
5.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other security breach.
5.3 Identity Verification
We reserve the right to request identity verification at any time. This may include government-issued identification, proof of address, hunting licenses, or other documentation. Failure to provide requested verification may result in account suspension or termination.
5.4 One Account Per Person
Each User may maintain only one account. Creating multiple accounts may result in termination of all associated accounts without refund.
6. Hunter Responsibilities & Obligations
6.1 Licensing & Permits
Hunters are solely responsible for obtaining and maintaining all required licenses, permits, tags, and stamps required by federal, state, and local law for the Activities they intend to conduct. This includes but is not limited to:
- Valid state hunting and/or fishing licenses for the state where the Property is located
- Species-specific tags and permits (deer tags, turkey permits, etc.)
- Federal migratory bird stamps (for waterfowl hunting)
- Habitat stamps or conservation stamps where required
- Non-resident licenses if hunting outside your state of residence
- Any special permits required for specific game or areas
6.2 Hunter Education
Many states require completion of hunter education courses. Hunters are responsible for completing all required education and certifications and providing proof upon request.
6.3 Regulatory Compliance
Hunters must comply with all applicable hunting and fishing regulations, including but not limited to:
- Season dates and legal hunting hours
- Bag limits and possession limits
- Weapon restrictions and specifications
- Method of take regulations
- Tagging and reporting requirements
- Transportation and storage requirements
- Trespassing laws and boundary compliance
6.4 Firearm Safety & Compliance
Hunters who bring firearms or other weapons to Properties must:
- Possess all required firearm permits and licenses
- Transport firearms in compliance with federal and state laws
- Follow all firearm safety protocols at all times
- Use only legal weapons and ammunition for the intended game
- Never discharge firearms while under the influence of alcohol or drugs
- Comply with all Property-specific firearm rules
6.5 Property Respect
Hunters agree to:
- Respect all Property boundaries and stay within designated areas
- Not damage, alter, or remove any structures, equipment, or natural features
- Remove all trash and leave the Property in the condition found
- Follow all rules established by the Landowner
- Not invite unauthorized individuals to the Property
- Report any damage or incidents promptly to the Landowner
6.6 Guest Responsibility
The booking Hunter is fully responsible for the actions, conduct, and compliance of all Guests they bring to the Property. All Guests must also comply with these Terms, and the booking Hunter agrees to ensure Guest compliance. The booking Hunter assumes all liability for Guest actions.
7. Landowner Responsibilities & Obligations
7.1 Property Ownership & Authority
By listing a Property on the Platform, Landowners represent and warrant that they:
- Are the legal owner of the Property OR have written authorization from the owner to list the Property
- Have the legal right to permit hunting, fishing, and recreational activities on the Property
- Have obtained all necessary permits or approvals for commercial recreational use
- Are not in violation of any lease, mortgage, HOA, or other agreements by listing the Property
7.2 Accurate Listing Information
Landowners must provide accurate and truthful information in their listings, including:
- Property size, boundaries, and location
- Available game species and wildlife (without guarantees)
- Amenities, facilities, and accommodations
- Access information and directions
- Any restrictions, rules, or limitations
- Accurate photographs that represent current conditions
7.3 Hazard Disclosure
Landowners have a duty to disclose known hazards and dangers, including but not limited to:
- Dangerous terrain features (cliffs, sinkholes, unstable ground)
- Water hazards (ponds, streams, wetlands)
- Dangerous wildlife known to inhabit the Property
- Hazardous structures or equipment
- Active agricultural or logging operations
- Neighboring properties with potential conflicts
- Any environmental hazards or contamination
- Areas where hunting is prohibited (near roads, buildings, etc.)
7.4 Property Maintenance
Landowners agree to maintain Properties in a reasonably safe condition and promptly address known hazards. This includes maintaining access routes, structures, and any facilities provided.
7.5 Insurance Requirements
Landowners are strongly advised to maintain adequate liability insurance that covers recreational activities on their Property. Landowners should verify with their insurance provider that their policy covers paid hunting and fishing access.
7.6 Tax Compliance
Landowners are solely responsible for reporting and paying all applicable taxes on income received through the Platform, including federal, state, and local income taxes, sales taxes, and occupancy taxes where applicable.
7.7 Verification of Hunters
Landowners are encouraged to verify Hunter documentation, including hunting licenses and identification, before granting Property access. The Platform provides tools for document sharing but does not verify authenticity.
8. State-Specific Hunting & Fishing Regulations
IMPORTANT: Hunting and fishing regulations vary significantly by state and are subject to change. Users are solely responsible for knowing and complying with current regulations in their state.
8.1 Acknowledgment of State Laws
By using this Platform, all Users acknowledge that:
- Hunting and fishing regulations differ in each of the 50 United States
- Regulations may vary by county, region, or specific wildlife management areas within states
- Regulations change frequently and Users must verify current requirements
- Ignorance of the law is not a defense against violations
- Hunt My Land does not provide legal advice regarding state regulations
8.2 Common State Requirements
While requirements vary, Hunters should be aware that most states require:
- State-issued hunting and/or fishing licenses (resident or non-resident)
- Hunter education certification (requirements vary by age and state)
- Species-specific permits, tags, or stamps
- Compliance with specific season dates
- Adherence to bag and possession limits
- Proper game tagging and reporting
- Orange/blaze clothing requirements during certain seasons

8.4 Special State Considerations
Users should be aware of special considerations in certain states:
- Trespass Laws: Some states have specific posting requirements or purple paint laws
- Leasing Requirements: Some states require written hunting lease agreements
- Outfitter/Guide Licensing: Some activities may require licensed outfitters
- Baiting Regulations: Baiting restrictions vary significantly by state
- Weapon Restrictions: Caliber, magazine capacity, and weapon type regulations vary
- Sunday Hunting: Some states restrict or prohibit Sunday hunting
- CWD Regulations: Chronic Wasting Disease regulations vary by state and region
9. Booking & Payment Terms
9.1 Platform Fee
Hunt My Land charges a non-refundable platform fee of $10.00 USD per booking. This fee is charged to the Hunter at the time of booking and covers platform services, payment processing, and customer support.
9.2 Booking Process
To complete a booking, Hunters must:
- Select available dates from the Property calendar
- Review and agree to Property-specific rules and requirements
- Provide required documentation as requested
- Submit payment for the full amount (rental fee + platform fee)
- Receive booking confirmation
9.3 Payment Processing
All payments are processed securely through Stripe, a third-party payment processor. By using the Platform, you agree to Stripe's Terms of Service. Hunt My Land does not store credit card information on its servers.
9.4 Landowner Payouts
Landowners receive their portion of the rental fee (total rental amount minus any applicable fees) within 2-4 business days after the reservation completion date. Payouts are processed through Stripe Connect, and Landowners must complete Stripe's onboarding process to receive payments.
9.5 Deposit Payments
Some Properties may require a deposit at the time of booking with the remaining balance due at a later date. Deposit and payment terms are displayed clearly during the booking process. Failure to pay the remaining balance by the due date may result in cancellation of the booking.
9.6 Currency
All prices and payments are in United States Dollars (USD).
10. Cancellation & Refund Policy
10.1 Hunter Cancellations
Hunters may cancel bookings according to the following schedule:
- 7 or more days before the reservation start date: 100% refund of the rental fee
- 3-6 days before the reservation start date: 50% refund of the rental fee
- Less than 3 days before the reservation start date: No refund
Note: The $10 platform fee is non-refundable in all cases.
10.2 Landowner Cancellations
Landowners who cancel a confirmed booking will result in a full refund to the Hunter, including the platform fee. Repeated cancellations by Landowners may result in listing suspension or account termination.
10.3 Weather & Force Majeure
Bookings are not automatically cancelled due to weather conditions. Hunters accept the risk of inclement weather. In cases of declared emergencies, natural disasters, or events beyond the control of either party (force majeure), refunds will be handled on a case-by-case basis at Hunt My Land's discretion.
10.4 Disputes
If a Hunter believes the Property substantially differed from its listing description, they may submit a dispute within 48 hours of the reservation start date. Hunt My Land will review disputes and may, at its sole discretion, issue partial or full refunds.
10.5 No-Shows
Hunters who fail to arrive for their reservation without prior cancellation ("no-show") will not receive any refund.
11. Safety Requirements & Protocols
11.1 General Safety
All Users acknowledge that hunting, fishing, and outdoor recreational activities are inherently dangerous and agree to prioritize safety at all times. Users must:
- Exercise reasonable care and caution while on Properties
- Follow all safety instructions provided by Landowners
- Use appropriate safety equipment (tree stand harnesses, flotation devices, etc.)
- Never participate in Activities while impaired by alcohol or drugs
- Communicate hunting locations and plans with others
- Carry appropriate first aid supplies
- Know the location of nearest emergency services
11.2 Firearm Safety
Users who bring firearms to Properties must adhere to the following safety rules:
- Treat every firearm as if it is loaded
- Never point a firearm at anything you do not intend to shoot
- Keep your finger off the trigger until ready to shoot
- Be certain of your target and what is beyond it
- Store firearms securely when not in use
- Transport firearms unloaded and in accordance with state law
- Use proper ammunition for your firearm
- Wear appropriate hearing and eye protection
11.3 Tree Stand Safety
Tree stand accidents are a leading cause of hunting injuries. Users agree to:
- Always use a full-body safety harness
- Inspect stands and straps before each use
- Never exceed weight limits
- Use a haul line for equipment
- Maintain three points of contact while climbing
- Use only stands that comply with TMA (Treestand Manufacturer's Association) standards
11.4 Water Safety
Users engaging in activities near water must:
- Wear appropriate flotation devices when required by law or conditions warrant
- Never wade in unfamiliar water without proper precautions
- Be aware of cold water dangers and hypothermia risks
- Comply with all boating safety regulations
11.5 Emergency Procedures
In case of emergency, Users should call 911 immediately. Users are encouraged to carry communication devices and share their location with others before entering remote areas. Hunt My Land is not an emergency service and cannot provide emergency assistance.
12. Assumption of Risk
12.1 Acknowledgment of Dangers
BY USING THIS PLATFORM AND PARTICIPATING IN ANY ACTIVITIES ON PROPERTIES BOOKED THROUGH THE PLATFORM, YOU EXPRESSLY ACKNOWLEDGE, UNDERSTAND, AND AGREE THAT:
- Hunting, fishing, and outdoor recreational activities are INHERENTLY DANGEROUS and involve significant risks of SERIOUS BODILY INJURY, PERMANENT DISABILITY, PARALYSIS, AND DEATH
- These risks include but are not limited to: accidental discharge of firearms, falls from tree stands, drowning, animal attacks, vehicle accidents, weather-related injuries, allergic reactions, and injuries from terrain or natural hazards
- Properties may contain hidden or unforeseen hazards that cannot be eliminated
- Other Users, Guests, or third parties may act negligently or recklessly
- Emergency medical services may not be readily available in remote locations
- Weather conditions can change rapidly and create dangerous situations
12.2 Voluntary Assumption
YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, associated with using the Platform and participating in Activities, even if arising from the negligence of Hunt My Land, Landowners, other Users, or third parties.
12.3 Personal Responsibility
You accept personal responsibility for your own safety and the safety of anyone you bring to a Property. You agree that you have the sole responsibility to assess the risks involved in any Activity and to determine whether you are physically and mentally capable of participating safely.
12.4 No Guarantees
Hunt My Land makes NO GUARANTEES regarding the safety of any Property, the conduct of any User, the accuracy of any listing, or the success of any hunting or fishing activity.
13. Release of Liability & Waiver
13.1 General Release
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Hunt My Land USA, LLC, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, representatives, successors, and assigns (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or relating to any loss, damage, injury, or death that may be sustained by you or your property, or any other person or property, in connection with your use of the Platform or participation in any Activity.
13.2 Scope of Release
This release includes claims arising from:
- The condition of any Property
- The conduct, actions, or omissions of any Landowner, Hunter, or third party
- Equipment failure or malfunction
- Weather conditions
- Wildlife encounters
- Medical emergencies or lack of emergency services
- Vehicle accidents
- Any other cause, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE of Released Parties
13.3 Release by Landowners
Landowners specifically release Hunt My Land from any claims arising from the conduct of Hunters or Guests on their Property, damage to Property, or any disputes with Users.
13.4 Waiver of Unknown Claims
You expressly waive any claims you may have under California Civil Code Section 1542 (or any similar statute in any other jurisdiction), which provides: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."
13.5 State-Specific Acknowledgments
Some states have laws that may limit or prohibit certain releases of liability. To the extent such laws apply, this release is intended to be enforced to the fullest extent permitted by law in each state. If any portion is found unenforceable in a particular state, the remaining provisions shall remain in full force and effect.
13.6 Survival
This release of liability shall survive termination of your account or discontinuation of Platform use.
14. Indemnification
14.1 User Indemnification
You agree to indemnify, defend, and hold harmless Hunt My Land USA, LLC, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, representatives, successors, and assigns from and against any and all claims, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Platform or participation in any Activities
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of any rights of another person or entity
- Any content you submit to the Platform
- Any property damage or personal injury caused by you or your Guests
- Any dispute between you and another User
14.2 Landowner Indemnification
Landowners additionally agree to indemnify Hunt My Land from claims arising from:
- The condition of their Property
- Inaccurate or misleading listing information
- Failure to disclose known hazards
- Injuries or damages occurring on their Property
- Tax-related disputes
- Zoning or permit violations
14.3 Hunter Indemnification
Hunters additionally agree to indemnify Hunt My Land from claims arising from:
- Hunting without proper licenses or permits
- Violations of hunting or fishing regulations
- Property damage caused during their visit
- Actions of their Guests
- Firearm-related incidents
- Trespassing on neighboring properties
14.4 Defense and Settlement
Hunt My Land reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense. You may not settle any claim without Hunt My Land's prior written consent.
15. Insurance Requirements & Recommendations
15.1 Platform Does Not Provide Insurance
Hunt My Land does NOT provide any insurance coverage for Users, Properties, or Activities. All Users are responsible for obtaining their own insurance coverage.
15.2 Landowner Insurance
Landowners are STRONGLY ADVISED to:
- Maintain comprehensive general liability insurance
- Verify that their policy covers paid recreational access
- Consider umbrella liability policies for additional protection
- Consult with an insurance professional about appropriate coverage limits
- Review their policy for exclusions related to hunting activities
15.3 Hunter Insurance
Hunters are STRONGLY ADVISED to:
- Maintain personal health insurance
- Consider hunting-specific accident insurance
- Obtain trip cancellation insurance for significant bookings
- Verify that any personal liability insurance covers hunting activities
15.4 No Verification
Hunt My Land does not verify or require proof of insurance from Users. Lack of insurance does not limit any User's obligations under these Terms.
16. Waiver of Claims
16.1 Mutual Waiver Between Users
All Users agree to waive any claims against Hunt My Land arising from disputes with other Users. Disputes between Hunters and Landowners are to be resolved directly between the parties or through the dispute resolution procedures in Section 18.
16.2 Waiver of Specific Claims
Users specifically waive claims against Hunt My Land for:
- Failed hunts or unsuccessful fishing trips
- Weather-related cancellations or disruptions
- Inaccurate wildlife population estimates
- Changes in hunting seasons or regulations
- Property access issues caused by road conditions or natural events
- Loss or theft of personal property
- Damage to vehicles
16.3 Covenant Not to Sue
You covenant and agree not to initiate or participate in any lawsuit, claim, or legal action against Hunt My Land for any matter released or waived in these Terms.
17. Limitation of Liability
17.1 Disclaimer of Warranties
THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. HUNT MY LAND EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
17.2 No Guarantee of Service
Hunt My Land does not guarantee that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information on the Platform.
17.3 Limitation of Damages
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HUNT MY LAND, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF HUNT MY LAND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
17.4 Maximum Liability
IN NO EVENT SHALL HUNT MY LAND'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO HUNT MY LAND IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).
17.5 State Law Variations
Some states do not allow the exclusion or limitation of certain damages. In such states, our liability shall be limited to the fullest extent permitted by applicable law.
18. Dispute Resolution & Binding Arbitration
18.1 Agreement to Arbitrate
YOU AND HUNT MY LAND AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM ("DISPUTES") WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT, except that either party may bring qualifying claims in small claims court.
18.2 Waiver of Jury Trial
BY AGREEING TO ARBITRATION, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You understand that arbitration procedures may be more limited than court procedures.
18.3 Arbitration Rules
Arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will take place in Washburn County, Wisconsin, unless the parties agree otherwise or the arbitrator determines that such location would be unreasonably burdensome.
18.4 Arbitration Costs
The party initiating arbitration shall pay the initial filing fee. If you are unable to afford the fee, Hunt My Land will pay it. Each party shall bear its own attorneys' fees unless the arbitrator awards fees to the prevailing party.
18.5 Informal Resolution
Before initiating arbitration, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
18.6 Arbitrator's Authority
The arbitrator has exclusive authority to resolve any dispute regarding the interpretation, applicability, or enforceability of this arbitration agreement. The arbitrator may award any remedy that would be available in court, but relief must be individual.
18.7 Opt-Out
You may opt out of this arbitration agreement by sending written notice to Hunt My Land at the address below within 30 days of first accepting these Terms. Your notice must include your name, address, email, and a clear statement that you wish to opt out of arbitration.
19. Class Action Waiver
YOU AND HUNT MY LAND AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Unless both you and Hunt My Land agree, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.
If this class action waiver is found to be unenforceable, then the entirety of the arbitration agreement shall be null and void, and the dispute shall proceed in court.
20. Intellectual Property Rights
20.1 Platform Content
All content on the Platform, including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Hunt My Land or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
20.2 Trademarks
"Hunt My Land," "Hunt My Land USA," and all related logos and marks are trademarks of Hunt My Land USA, LLC. You may not use these marks without prior written permission.
20.3 User Content License
By submitting content to the Platform (listings, photos, reviews, etc.), you grant Hunt My Land a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
20.4 Copyright Complaints
If you believe any content on the Platform infringes your copyright, please contact us with the information required under the Digital Millennium Copyright Act (DMCA).
21. User Conduct & Prohibited Activities
You agree NOT to:
- Provide false, misleading, or inaccurate information
- Impersonate any person or entity
- Engage in fraudulent activities or scams
- Violate any applicable laws, regulations, or these Terms
- Infringe upon the rights of others
- Harass, threaten, or intimidate other Users
- Post illegal, offensive, or inappropriate content
- Attempt to circumvent Platform security measures
- Use automated systems or bots to access the Platform
- Interfere with the proper functioning of the Platform
- Collect or harvest User information without consent
- Use the Platform for any illegal hunting or fishing activities
- Circumvent Platform payment systems
- Engage in price manipulation or false advertising
- Create multiple accounts
22. Termination
22.1 Termination by User
You may terminate your account at any time by contacting us. Termination does not relieve you of obligations under existing bookings or these Terms.
22.2 Termination by Hunt My Land
We reserve the right to suspend or terminate your account and access to the Platform at any time, without notice, for any reason, including but not limited to:
- Violation of these Terms
- Illegal activity
- Fraudulent behavior
- Conduct harmful to other Users or the Platform
- Extended periods of inactivity
22.3 Effect of Termination
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
23. Governing Law & Jurisdiction
23.1 Governing Law
These Terms and any dispute arising out of or related to these Terms or the Platform shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions.
23.2 Jurisdiction
For any claims not subject to arbitration, you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Washburn County, Wisconsin.
23.3 State Law Compliance
If you are a resident of a state with consumer protection laws that provide greater protection than these Terms, the more protective provisions shall apply to you to the extent required by law.
24. Miscellaneous Provisions
24.1 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Hunt My Land concerning the Platform.
24.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
24.3 Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Hunt My Land's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
24.4 Assignment
You may not assign or transfer your rights under these Terms without Hunt My Land's prior written consent. Hunt My Land may assign its rights without restriction.
24.5 Force Majeure
Hunt My Land shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
24.6 Notices
We may provide notices to you via email, posting on the Platform, or other reasonable means. You agree to keep your contact information current.
24.7 Headings
Section headings are for convenience only and do not affect the interpretation of these Terms.
24.8 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights in any person, except as expressly provided herein.
24.9 Modifications
Hunt My Land reserves the right to modify these Terms at any time. Material changes will be communicated via email or Platform notification. Continued use of the Platform after such changes constitutes acceptance of the modified Terms.

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE HUNT MY LAND PLATFORM, YOU ACKNOWLEDGE THAT:
- You have carefully read and understand all provisions of this Agreement
- You are at least 18 years of age and have the legal capacity to enter into this Agreement
- You voluntarily agree to all terms, conditions, and notices contained herein
- You understand this Agreement includes an assumption of risk, release of liability, indemnification, and binding arbitration provisions that affect your legal rights
- You have had the opportunity to consult with legal counsel before accepting these Terms
This Agreement is effective as of the date you first access or use the Platform.
